The Proposed Initiative

SECTION 1. Statement of Findings and Declaration of Purpose

The People of the State of California find and declare all of the following:

(a) That in the interest of ensuring the effective and efficient governance of the State of California, there is a need to set reasonable age limitations for individuals serving in elected, appointed, and judicial offices.

(b) That the demographic of those eligible to hold public office should more closely reflect the overall demographic of the citizenry, to ensure that governance is carried out in a manner that is responsive to the needs and aspirations of all age groups.

SECTION 2. Amendments to California Law

(a) Article X (to be assigned) is added to the California Constitution, to read:

Section 1. Age Limitation for Elected, Appointed, and Judicial Officials.

No person shall be eligible for election or appointment to any elected, appointed, or judicial office of the State of California, its political subdivisions, local government, special district, or any agency thereof if that person will reach the age of seventy-five (75) years during the term for which they are seeking election or appointment.

Section 2. Non-Retroactivity.

This amendment shall not be retroactive and shall apply only to elections and appointments occurring on or after January 1, 2025.

Section 3. Exception.

This amendment shall not apply to individuals who are already in office prior to January 1, 2025. Such individuals may complete the term for which they were elected or appointed, but shall be ineligible for re-election or reappointment if they will reach the age of seventy-five (75) years during the new term.

Section 4. Implementation.

The Legislature may pass such laws as may be necessary for the enforcement of this amendment.

SECTION 3. Legal Safeguards

(a) If any provision of this Act or its application to any person or circumstances is held invalid, that invalidity shall not affect other provisions or applications of the Act that can be given effect without the invalid provision or application, and to this end, the provisions of this Act are severable.

SECTION 4. Effective Date

(a) This Act shall become effective on January 1, 2025.
